OF VACCIJIATIOM. 1. The ttovereor ir. Council may by procl* mation pel in force the provisions of this chapter in this colony and its dependencies, or in any district or pert thereof. 2. When Hii- chapter >hall have, been put into operation i>> anv distrtel <>v place, the Vaccinators sliall carry ont the provisions ol ill!-; chapter by making ciHjniries as to such persons a> have not been cllcctively vaccinated, or who hare not already had smallpox, and shall require them te be yaccinated; or, in the case i>l children, shall require their parents or guardians to submit snch children lor v:ic<'illation. 3. Any parent or guardian of anv child so required to be vaccinated, or any other person in contravention of or failing to comply vvitlt ihc provisions of this chapter, or any person wilfully obstructing a Vaccinator in carrying out the provisions ot this chapter, or any peron vaccinated under this chapter not coming within the provisions of section ii\c of this chapter, who, upon the performance of sucli v/ccination, shall refuse or neglect to pay the Vaccinator the fee herein prescribed, shall incur a penally not exceeding two dollars tor every offence, and in default of payment thereof, shall be liable to be imprisoned fora period not exceeding one week : Provided thai any perso« refusing to be vaccinated, or any parent or guardian refusing to submit a child for vaccination, shall not be liable to any penalty if it shall be trade to appear that there is a satisfactory reason as regard* health for such person or child not being vaccinated; bnt the burthen of shewing mi h c iu-e sliali rest with the party charged. ■1. In any proceeding under this chapter, the .lu-tic: may, with or without inflicting a penally, make an order that vaccination shall take place; and every subsequent refusal or ncglec) to obey .-ueli order shall be deemed to lie a new offence. '>. Upon the production ol a detailed statement, giving the name of each person vaccinated by him, sworn to by the Vaccinator before and certified by a Magistrate, and upon the production ol a certificate by a Poor Commissioner that v.ich person is ;i pauper or on tl>(. pauper li-t, or a certificate by a Magistrate, Justice, Clergyman, or Poor Commissioner, that such person is unable to pay the prescribed fee, the Vaccinator shall be entitled tf) receive remuneration from the colony at the rate ot twenty-live cents for every -11eh person upon whom the operation of vaccination has been successfully performed. G. The Governor in Council shall appoint Vaccinators for the purposes of Ihie chapter. 7. 'J"11c Governor in Council may make regulation* for the more effectual execution of this chapter, and such regulations shall have tJx: same force as if embodied in this chapter. b.
